David Ayers is a trial lawyer and counselor. Ayers has tried numerous jury and non-jury cases in state and federal courts.  Those cases have involved representation of plaintiffs and defendants in commercial law, tort, breach of contract, premises and products liability disputes.  Ayers has also tried insurance coverage disputes on behalf of insureds as well as fiduciary duty cases on behalf of both plaintiffs and defendants.

Over the last decade, Ayers’ practice has focused largely on ownership and control fights involving owners of both large and small closely held corporations. For example, David was co-lead counsel, along with Philip Werner, for one of two plaintiffs in a shareholder oppression case that settled in favor of the plaintiffs for a significant amount.  In addition to the settlement, in 2015, Ayers teamed again with Philip Werner to secure the largest jury award on record in a legal malpractice case. That case ranked sixth among all reported verdicts nationally according to the National Law Journal.

Beyond fiduciary and professional-liability disputes, David has also represented Policyholders in disputes with their insurers and has settled a number of those cases for significant amounts of dollars.  David also serves as national coordinating counsel for a Fortune 100 E&P company involving the company’s toxic tort docket. In connection with that representation, he has personally handled hundreds of toxic tort cases involving thousands of plaintiffs and assists and oversees local counsel in a number of jurisdictions throughout the United States.

David graduated from the University of Oklahoma Law Center with honors and as a member of University of Oklahoma Law Review in 1992. David began his practice at the Houston office of Fulbright & Jaworski, L.L.P.   At Fulbright, he handled a broad range of litigation matters including tort, insurance coverage, commercial, and maritime matters.  In 2000, Mr. Ayers left Fulbright to become a partner at Werner Ayers, L.L.P.  Mr. Ayers is rated AV preeminent by Martindale Hubbell.
