We represented a municipal utility district against an engineering firm for its defective design of a flood control detention pond seeking damages of over $1 million. The detention pond suffered a major structural wall failure. As part of the representation, we assisted the client in developing a plan for the replacement of the entire detention pond and obtaining a new engineering firm. We obtained a settlement in excess of the engineering firm’s policy limits.

We have represented numerous other municipal utility districts in court proceedings and arbitrations concerning construct defects and delays, performance and payment bonds, engineering errors and omissions, and other disputes.

While at his previous firm, partner Jason Williams represented a major pipeline company in a breach of contract case against a pipeline construction contractor related to the failure of large-diameter natural gas pipeline. The case involved issues related to welding quality and an investigation by the Pipeline and Hazardous Materials Safety Administration. He also represented a major pipeline company in a breach of contract case against a pipeline construction contractor for claims related to cost-overruns and defective pipe in an interstate large-diameter natural gas pipeline.

We represented a developer of a large mixed-use development in Houston against a land surveyor for its errors and omissions in failing to properly locate and indicate existing overhead electrical power lines and corresponding easements. We also simultaneously made a claim against the title insurer. We achieved a full recovery of damages and attorney’s fees shortly after suit was filed.

We represented owners in lawsuit in Montgomery County, Texas against their general contractor for construction defects and their construction lender for breach of a financing agreement for failing to administer the construction draw process. We obtained $1.2 million arbitration award and judgment, including damages, forgiveness of debt, and attorney’s fees. We defeated the lender’s attempts to appeal the case to both the Beaumont Court of Appeals and the Texas Supreme Court. We obtained full satisfaction of the judgment against the lender after we obtained the appointment of a post-judgment receiver and froze the lender’s assets.

We represented a bank against the purchaser of an office building in a $10 million case alleging that the bank failed to disclose construction defects. After uncovering significant anomalies in the purchaser’s business practices and filing summary judgment, the case settled for a nominal amount.
