Houston Trial Lawyers Philip Werner, David Ayers Join Trial Law Boutique Bissinger, Oshman, Williams & Strasburger

HOUSTON – Houston trial attorneys Philip Werner and David Ayers, co-founders of Werner Ayers LLP, have joined Bissinger, Oshman, Williams & Strasburger LLP, adding significant courtroom and corporate depth to the litigation boutique.

“Our firm has a trial culture. We represent both plaintiffs and defendants in cases that go to trial far more often than average. That experience has empowered us to take on the largest cases against the largest firms,” said David Bissinger, co-founder of Bissinger, Oshman & Williams, or BOWS.

“Philip and David have tried the kinds of cases we love to try, and with the same operating principle we embrace: using a small force to defeat larger, well-entrenched opponents. In addition to a fabulous track record in major trials, they also bring deep client relationships, particularly in the energy industry.”

Mr. Werner has tried more than 125 jury trials in state and federal courts. According to the National Law Journal, he has secured Top 10 verdicts nationally on both the defense and plaintiff side. In 2015, with co-lead counsel Mr. Ayers, he secured the largest jury award on record in a legal malpractice case. It also ranked sixth among all reported verdicts nationally that year.

Mr. Werner and Mr. Ayers have worked together in major corporate fiduciary, commercial, and tort cases, including winning a confidential settlement in 2012 in one of the largest shareholder oppression cases ever filed on behalf of Werner Ayers client Scott Martin, whom Mr. Bissinger also represented.

As Mr. Ayers observed, “We have worked closely with David, particularly in his successful defense of Mr. Martin in a major arbitration related to the other matters in which we were representing him. BOWS partner Jason Williams has similar experience in large corporate disputes, and we share a common background as alumni from Fulbright & Jaworski.”

Mr. Werner has extensive experience in litigating fiduciary duty claims for both plaintiffs and defendants, including both professional malpractice and corporate fiduciary disputes. He also represents Fortune 100 companies and individuals in litigation involving contract disputes, Policyholder claims against insurers, property damage claims stemming from large industrial accidents, cancer claims, products liability claims, real estate disputes, and allegations of wrongful termination. He is Board Certified in both Civil Trial Law and Personal Injury Trial Law by the Texas Board of Legal Specialization. He is an associate member of the American Board of Trial Advocates.

In addition to his fiduciary trial practice, Mr. Ayers serves as defense counsel for a Fortune 100 company, coordinating and defending a mass tort docket across the country. His practice includes insurance coverage claims for Policyholders as well as general commercial litigation, toxic tort litigation and products liability, maritime, and general personal injury litigation.

“Combining our practices was an easy decision,” said Mr. Ayers. “We had a good history of past success working together. The BOWS team shared space with us following Hurricane Harvey, and at that point several more matters came in that allowed us to continue to collaborate, including a major arbitration for a large oilfield services company, an international probate and corporate fiduciary dispute, and the defense of a multimillion-dollar finance dispute. We obtained great results for the clients in each of these matters, and the success has further energized us as we formally announce our merger.”

The new Bissinger, Oshman & Williams office is at 2229 San Felipe, Suite 1500, in Houston.
